Variation of Summary Instalment Orders

A person subject to a Summary Instalment Order (SIO), any of the creditors or the supervisor may apply to have an SIO varied.  Applications must clearly state the reasons for the variation request and details of requested changes.

If the variation would detrimentally affect the interests of any creditor(s), (for example, by lengthening the term of the order, or reducing the amount creditors will receive), the supervisor is required to notify all affected parties including reasons why the order should be varied.

Creditors then have ten working days from date of notification to object to the Official Assignee.  The Official Assignee has authority to make decisions regarding variations and will advise the applicant and supervisor of the decision.

Where the Official Assignee consents to the proposed variation, the supervisor must then notify creditors.
