If you are owed money by a person who has become bankrupt, entered a No Asset Procedure (NAP) or Summary Instalment Order (SIO), or by a company that has gone into liquidation, you are entitled to file a claim for what you are owed and share in any distribution that may be paid out of the insolvent estate.
Insolvency insight
The Insolvency Amendment Bill was introduced to Parliament in early March and aspects of how personal insolvency is administered in New Zealand will be modified when the Bill is implemented. To raise awareness of the changes to be made to the Insolvency Act 2006 when the Bill is enacted, the Insolvency and Trustee Service will publish an information series touching on different aspects of the Bill. The final instalment of the Insolvency Insight series focuses on fraudulent debts.
Debt to Work and Income
The position concerning debt owed to Work and Income and their ability to pursue debts owed by debtors that have entered or been discharged from bankruptcy and NAP is currently under review.

The application form to apply to be a summary instalment order supervisor under the Insolvency Act 2006 is now available.
Personal insolvency regulations gazetted
The reform of the personal insolvency law regime has moved another step forward with notice being given in the New Zealand Gazette on 1 November 2007 of the Insolvency Act Regulations 2007.

Minister of Commerce, Simon Power and Australian Senator Nick Sherry have announced an intention for Australia and New Zealand to begin working together on improving cross-border insolvency procedures and arrangements to assist creditors on both sides of the Tasman.
