What if I have information or a complaint about a bankrupt | NAP | SIO | liquidation?

The National Enforcement Unit (NEU) investigates and, where appropriate, prosecutes offences.


Referral of cases and complaints

Any member of the public can refer a complaint to the NEU regarding breaches of legislation.  The nature of the complaints received varies.

 

Selection of cases

In deciding to prosecute the NEU considers:

  • public interest
  • extent of offending
  • seriousness of offending
  • time elapsed since the offence
  • other available remedies.

Legal action is expensive, lengthy and must serve the desired purpose.  Significant proof is required before any case can proceed.  The NEU Manager has discretion in selection of cases.
